In general, the divorce process in Indonesia is divided according to the religion under which the couple was married: couples married under Islamic law file for divorce at the Religious Court (Pengadilan Agama), while non-Muslim couples file at the District Court (Pengadilan Negeri). Below is a general overview you should know before starting the process.
1. Two court pathways: Religious Court vs. District Court
At the Religious Court, there are two main terms: a wife-initiated divorce petition (cerai gugat) and a husband-initiated divorce petition (cerai talak). Meanwhile, at the District Court, a divorce suit can be filed by either the husband or the wife under a relatively similar mechanism.
2. Documents at the Religious Court (Muslim couples)
- A divorce petition (cerai gugat) or a divorce application (cerai talak), addressed to the Chief Judge of the Religious Court
- The original marriage book/marriage certificate, along with a stamped, legalized photocopy
- Photocopies of the husband's and wife's ID cards (KTP), along with the Family Card (KK)
- Photocopies of the children's birth certificates, if the couple has children
- A permission letter/certificate from a superior, specifically for civil servants (PNS), members of the military (TNI), or police (Polri)
- An advance payment for court costs, or an application to litigate free of charge (prodeo) with a Certificate of Inability to Pay (SKTM) for those who cannot afford the fees
The petition is filed at the Religious Court in the jurisdiction of the respondent/defendant's (termohon/tergugat) place of residence, and must go through mediation (mediasi) before the trial proceeds further.
3. Documents at the District Court (non-Muslim couples)
- A divorce petition (several copies) clearly stating the reasons/grounds for the divorce
- The original marriage certificate from the Population and Civil Registration Office, along with a stamped photocopy
- Photocopies of both parties' ID cards (KTP), along with the Family Card (KK)
- Photocopies of the children's birth certificates, especially if child custody is also being requested
- Proof of ownership of joint marital assets (certificates, vehicle registration/BPKB, etc.), if there is a dispute over joint marital assets (harta bersama/gono-gini)
- At least two witnesses who are familiar with the household situation, to give testimony at the trial
The petition is filed at the District Court in the jurisdiction of the defendant's (tergugat) place of residence, and must also go through mediation (mediasi) before the examination of the case's merits.
4. General stages of the trial process
- Filing the petition at the court corresponding to the respondent/defendant's place of residence.
- Summoning the parties by the court to attend the first hearing.
- Mediation process — the court will first attempt to reconcile the two parties.
- Examination of the case's merits — if mediation is unsuccessful, the trial continues with the presentation of evidence and witness testimony.
- Verdict — the court hands down its decision once the entire evidentiary process is complete.
5. Other things you need to prepare
Besides the documents above, there are several other matters you should think about from the outset: an agreement on child custody (if you have children), the division of joint marital assets (harta bersama/gono-gini), and post-divorce support (if relevant). Every case has different characteristics — for example, if your spouse's whereabouts are unknown, if the marriage involves a foreign national (mixed marriage), or if there is a complex dispute over joint assets — so consulting directly with a divorce lawyer is strongly recommended to keep the process on track and efficient.
